DISTANCE SALES AGREEMENT

1. PARTIES

This Distance Sales Agreement (“Agreement”) is entered into electronically between the following parties.

Buyer
The individual or legal entity who places an order through the Seller’s website. The Buyer’s name, address, and contact details are those provided during the order process.

2. SUBJECT OF THE AGREEMENT

This Agreement regulates the rights and obligations of the parties regarding the sale and delivery of products ordered electronically by the Buyer from the Seller’s website, in accordance with applicable distance selling and consumer protection regulations.

3. PRODUCT INFORMATION AND PRICING

3.1. The type, quantity, description, color, dimensions, sales price, payment method, and delivery details of the products are specified in the order summary approved by the Buyer prior to completing the purchase.

3.2. All prices include applicable taxes unless otherwise stated. Shipping costs are charged to the Buyer unless explicitly specified.

3.3. The Seller reserves the right to change prices and product details without prior notice. The price valid at the time of order confirmation shall apply.

4. DELIVERY

4.1. Products shall be delivered to the address provided by the Buyer during the order process via a contracted shipping provider.

4.2. Delivery times may vary depending on product availability, production time, and shipping destination. Handmade and made-to-order artworks may require additional production time, as stated on the product page.

4.3. The Buyer is responsible for inspecting the package upon delivery. Any damaged or missing items must be reported immediately to the shipping carrier and documented with a delivery report.

5. RIGHT OF WITHDRAWAL

5.1. The Buyer has the right to withdraw from this Agreement within 14 (fourteen) days from the date of delivery, without providing any reason.

5.2. To exercise the right of withdrawal, the Buyer must notify the Seller in writing via email within the withdrawal period.

5.3. The right of withdrawal does not apply to products that are made to order, customized or personalized, produced according to the Buyer’s specifications (including color, size, design, or finish), or handmade artworks created specifically for the Buyer.

5.4. Returned items must be unused, undamaged, and returned in their original packaging.

6. RETURNS AND REFUNDS

6.1. Upon receipt of the returned product and confirmation of its condition, the Seller shall refund the product price within 14 days.

6.2. Refunds shall be made using the same payment method used by the Buyer for the original transaction.

6.3. Return shipping costs are borne by the Buyer unless the product is defective or incorrectly delivered.

7. SELLER’S RIGHTS AND FORCE MAJEURE

7.1. The Seller may cancel the order and refund the Buyer in case of unforeseen circumstances, technical issues, supply disruptions, or force majeure events.

7.2. Force majeure includes but is not limited to natural disasters, pandemics, transportation disruptions, customs delays, strikes, or governmental restrictions.

8. GENERAL PROVISIONS

8.1. By placing an order, the Buyer confirms that they have reviewed and accepted all product descriptions, pricing details, and this Agreement.

8.2. The Buyer acknowledges that colors, finishes, and textures of handmade artworks may show slight variations due to artistic processes and screen differences.

8.3. The Seller shall not be held liable for delays caused by customs procedures, shipping carriers, or incorrect information provided by the Buyer.

9. GOVERNING LAW AND JURISDICTION

This Agreement shall be governed by the laws of the Republic of Turkey.
In case of disputes, Consumer Arbitration Committees and Consumer Courts in Turkey shall have jurisdiction, subject to mandatory consumer protection rules.

10. EFFECTIVE DATE

This Agreement becomes effective once the Buyer completes the order and confirms acceptance electronically. By placing an order, the Buyer is deemed to have accepted all terms of this Agreement.
